01Acceptance of terms

Please review these Terms and Conditions before proceeding.

By clicking "I agree" or "I accept," or by downloading, installing or using the services, you provide your specific consent and agree to the terms and conditions outlined in this document. If you do not agree, please refrain from clicking "I agree," downloading, installing or using the services.

02Definitions

Throughout these Terms, the following words carry the meanings set out below:

Application / App

The digital platform (software) developed by our company to provide lending services, known as "Paisa24Finance."

Lender

Barota Finance Limited and its lending partners.

Lending Partner

A bank or NBFC with which the company has entered into an agreement for lending.

We / us / the Company

Barota Finance Limited, a Non-Banking Financial Company.

Loan

The financial assistance you apply for through our Platform, approved and provided by the Lender subject to conditions.

Loan Agreement

The agreement between the Lender and the customer, in physical or digital form.

Outstanding amount

The loan, interest and fees owed by you to the Lender on the due date.

Platform

Both the mobile app and the website.

Services

The Lender's ability to grant, approve and provide short-term loans through the platform.

User data

Any information, documents or materials provided by you to our company.

03Services

Our Services allow you to apply for a loan if you meet the requirements specified within the app. By using our service, you acknowledge that our company is responsible for collecting, verifying, tracking your location, confirming and validating the User Data, documents and other information required by the Lender to approve the loan. You grant the Lender permission to allow our company to collect and store your User Data through the Mobile Application Form (MOF) available on the Platform.

To access the Services, you must register and log in. During the application you will submit information including your name, email, gender and date of birth, along with a password, photograph, contact and mobile number, and login credentials. This also includes financial details such as bank statements, income, bank account numbers, PAN, KYC data, credit information company data and other relevant information. By signing up, you authorise us to import your personal information from third-party platforms and to send you personalised calls, messages, emails and updates.

Once you have verified and uploaded your information in the MOF, the Company will carry out the necessary verification. Upon successful verification you may become eligible for loan approval, subject to the Lender's eligibility criteria. You may then be required to complete additional forms such as the ECS or NACH mandate, provide a cheque, or other documentation. Once the required documents are collected, the Lender will disburse the loan amount per the loan agreement.

It is your responsibility to repay the loan amount on the specified date(s) in your Mobile Application Form.

If you uninstall or discontinue the Services, you remain responsible for settling any outstanding amounts. You are solely accountable for actions taken using your User Account and must maintain its confidentiality. The Company reserves the right to reject or approve your registration without prior notice.

04Licence

To utilise the Services, you must download and install the app. By accessing and using the Services, you confirm that you are of legal age and able to understand, agree to and abide by these Terms. You are granted a limited right to download, install, access and use the App on your mobile phone, tablet or other compatible devices.

While the Company reserves the right to provide maintenance and support, it is not obligated to do so. You may subscribe to updates and upgrades through the online stores; if you choose not to, certain features may become unavailable. The App is licensed to you, not sold, and may only be used in accordance with these Terms.

05Restrictions

By using our Platform and Services, you agree not to:

• Engage in fraudulent activities or misuse the Platform for illegal purposes.
• Copy, sell or resell any part of the Platform.
• Upload prohibited, harmful, threatening, abusive, harassing or offensive content.
• Impersonate others or manipulate content origins.
• Send unsolicited advertising, spam or unauthorised solicitation.
• Upload viruses or malicious code, or disrupt or damage the Platform or its networks.

You must also comply with all applicable laws and regulations, whether intentionally or unintentionally.

06Content & proprietary rights

Content available

While using our Platform, we make no warranties regarding the available content, including data files, text, software, audio, images or videos. We are not responsible for any content posted or made available through the Platform unless specifically stated otherwise in these Terms.

Proprietary rights of the Company

By registering, you grant us full rights, including intellectual property rights, to the content and Platform. You agree to respect any logos, service marks or trademarks associated with our Platform. Unauthorised use of such intellectual property may violate applicable laws.

07Third-party links, ads & ancillary services

Links to third-party sites

The Platform may contain links to external websites owned and operated by third parties not affiliated with us. These sites are independent and beyond our control; we make no representations or warranties regarding their content. Inclusion of links is for convenience only and does not imply endorsement. Your decision to access them is at your own discretion.

Third-party advertisements

The presence of third-party advertisements does not indicate our endorsement of the advertised products or services. Any interactions or transactions with third-party advertisers are your sole responsibility.

Ancillary services

The Platform may provide additional services such as chat rooms, blogs and feedback sections. These must not be used for any illegal activities. The Platform may feature advice or opinions from experts, but we do not guarantee their accuracy or reliability. Information provided does not constitute legal, financial, tax, investment or other professional advice. We reserve the right to modify or delete any information at our discretion.

08Termination

The Company reserves the right to terminate these Terms under specific circumstances, including but not limited to:

• Your violation of any of these Terms.
• Our legal obligations.
• Our decision to discontinue the Services or operating the Platform.
• Expiration of your licence to use the App.
• Failure to settle the outstanding amount, the Company may continue to monitor your activities even after termination or uninstallation until all debts are fully paid.

Failure to make necessary payments will result in the forfeiture of all rights and licences granted under these Terms, and you must immediately cease using the Platform and Services while fulfilling your outstanding obligations.

09Warranties, indemnity & liability

Disclaimer of warranties

You acknowledge that you use the Services and Platform at your own risk. They are provided on an "as is" and "as available" basis. The Company provides no express or implied warranties, including merchantability, fitness for a particular purpose or non-infringement. We do not guarantee that the content will be complete or accurate, or that the Services will be consistently available, rapid, secure or error-free.

Indemnity

You agree to indemnify and hold harmless the Company, its subsidiaries, affiliates, officers, employees, agents, co-branders and partners from any third-party claims, including attorneys' fees, arising from: (i) your failure to comply with these Terms; (ii) your infringement of other users' rights; (iii) your unauthorised use or misuse of the Platform or Services; and (iv) any violation of applicable laws.

Limitations of liability

The Company, its directors, employees, agents or service providers shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising from: non-use or inability to use the Services; inability to access the Platform; delays or unavailability; performance issues; virus infection to your devices; or server issues related to the Services.

10Force majeure

The Company shall not be held liable for any damages, losses or disruptions due to non-delivery of Services resulting from natural events, forces or causes beyond its reasonable control. Such events may include internet failure, computer or telecommunication equipment failure, changes in regulations imposed by the Reserve Bank of India or any government body, riots, storms, civil disturbances, electrical failure, floods and other similar occurrences.

12Law, privacy & miscellaneous

Privacy Policy

We collect, share and process personal information in accordance with our Privacy Policy, which outlines the purposes and practices of our data handling. The Company reserves the right to update these Terms at any time; updates are effective immediately upon posting, and your continued use constitutes acceptance of the revised Terms.

Choice of law & jurisdiction

This Agreement is governed by the laws of India, irrespective of conflict-of-law principles. Any disputes arising from or in connection with this Agreement shall be exclusively resolved by the courts located in Chandigarh (UT), India.

Miscellaneous

By using our Services, you agree to these Terms, the Loan Agreement, the Mobile Application Form and the Privacy Policy, which together constitute the complete agreement between you and the Company. Any claims arising from the Services or Terms must be filed within one year from the date of first use, or they will be permanently barred. If any part of the Terms is deemed invalid, the remaining terms continue in full force.
